Regulations of the Catering Food Box website

§ 1 General provisions and service provider details

  1. These Regulations define the rules for the use of services provided by Customers CATERING FOODBOX LIMITED LIABILITY COMPANY.

  2. Service Provider details:

  3. The regulations are available in electronic form on the website www.catering-foodbox.pl and in paper form at the Service Provider's registered office.

  4. The Customer is obliged to read the Regulations before placing an Order.


§ 2 Definitions

§ 3 Services and placing orders

  1. The service provider provides event catering services consisting of:

    • preparing meals in accordance with the Product description on the website,

    • packaging meals in a way that ensures safe transport,

    • delivery of meals to the Delivery Address.

  2. Ways to place orders:

  3. In order to place an Order via the website, the Customer:

    • selects Products,

    • provides Customer Data (name, surname, e-mail address, telephone number, delivery address),

    • chooses the payment method,

    • places an Order by clicking the "I am ordering with an obligation to pay" button.

  4. After placing the Order, the Customer will immediately receive the following information at the provided e-mail address:

    • confirmation of receipt of the Order,

    • the content of these Regulations,

    • instructions on the right to withdraw from the contract (template declaration).

  5. The contract is concluded when the Customer receives an e-mail confirming acceptance of the Order.


§ 4 Prices and payments

  1. All prices of Products listed on the website are prices  gross (include VAT).

  2. Prices do not include delivery costs, unless the Service Provider expressly states otherwise.

  3. Payment terms:

    • when paying on delivery or by online transfer (PayU, Przelewy24) – before delivery,

    • when paying by traditional transfer – within 3 business days of placing the Order.

  4. The Service Provider reserves the right to change the prices of the Products, but the prices applicable to the placed Order are not subject to change.


§ 5 Delivery

  1. Delivery is only possible within the area the city of Warsaw and neighboring towns (detailed list available on the website).

  2. Delivery time:

    • standard: on the day indicated by the Customer when placing the Order,

    • minimum delivery time: 24 hours from placing the Order (unless the Product requires longer preparation, of which the Customer is informed).

  3. Delivery hours: agreed individually with the Client by telephone or e-mail.

  4. Shipping costs:

    • free of charge – in Warsaw and indicated locations (for orders above 1000),

    • paid – according to the price list on the website.

  5. Upon receipt of the shipment, the Customer is required to check the condition of the packaging and the order's conformity. If any damage is visible, a damage report should be completed with the carrier.


§ 6 Withdrawal from the contract (for Consumers)

  1. The Consumer has the right to withdraw from the Agreement without giving any reason within 14 days from the date of delivery of the Product.

  2. The deadline is deemed to have been met if the Consumer sends the declaration before its expiry (e.g. to the e-mail address: info@catering-foodbox.pl or by letter).

  3. Exceptions to the right of withdrawal (Article 38 of the Consumer Rights Act):

    • The service is provided with the express consent of the Consumer, who has been informed that after the service has been provided he loses the right to withdraw from the contract – applies to catering with delivery on a specific date (meals prepared to order, perishable). In such a case, the right of withdrawal expires upon commencement of the service.

  4. In the absence of an exception (e.g. the order is not subject to rapid perishability):

    • The consumer returns the Product at his own expense,

    • The Service Provider will refund all payments received within 14 days.

  5. The template for the declaration of withdrawal is Appendix 1 to the Regulations.


§ 7 Complaints about Products and Services

  1. The basis of the Service Provider's liability towards the Customer (Consumer) for non-conformity of the goods with the contract is warranty regulated in Article 556 et seq. of the Civil Code.

  2. Complaints can be submitted:

    • in writing to the following address: Kłobucka Street 11, 02-699 Warsaw,

    • via e-mail to the following address: info@catering-foodbox.pl,

    • by phone at: +48 579 774 565.

  3. The complaint should include:

    • Client's name and surname,

    • Order number,

    • delivery date,

    • description of the problem (e.g. stale food, missing items in the order, delay),

    • proposal for a resolution method (exchange, price reduction, refund).

  4. Deadline for consideration of complaints: 14 calendar days from the date of its receipt by the Service Provider.

  5. The Customer will be informed about the procedure for handling the complaint via e-mail or in writing.

  6. If the complaint is accepted, the Service Provider:

    • replaces the defective Product with a new one (with the next delivery), or

    • refunds the appropriate part of the price (proportionate to the extent of the defect), or

    • in the event of a significant defect, the Customer withdraws from the contract and returns the entire price.


§ 8 Customer Account

  1. The Customer Account is free.

  2. Creating an Account requires providing an email address and password and accepting the Terms and Conditions.

  3. The Customer may delete his Account at any time without giving any reason.

  4. The Service Provider may block the Account in the event of a violation of the Regulations.


§ 9 Complaints regarding the operation of the website

  1. The Service Provider will make every effort to ensure the proper operation of the website.

  2. Complaints related to the operation of the website should be sent to the following e-mail address: info@catering-foodbox.pl.

  3. Complaints will be considered within 30 calendar days from the date of their receipt.


§ 10 Liability

  1. The Service Provider is not liable for interruptions in the provision of services resulting from reasons beyond its control (including internet connection failures, force majeure).

  2. The Service Provider is not responsible for the content of information and opinions provided by website visitors, to the extent permitted by law.

  3. In relation to Consumers, the provisions regarding liability apply in accordance with mandatory legal provisions, which cannot be changed to the detriment of the Consumer.


§ 11 Final provisions

  1. In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular:

    • Act of 18 July 2002 on the provision of services by electronic means,

    • Act of 23 April 1964, the Civil Code,

    • Act of 30 May 2014 on consumer rights.

  2. Any disputes arising between the Service Provider and the Customer (Consumer) will be resolved by the competent court in accordance with the provisions of the Code of Civil Procedure.

  3. The Service Provider reserves the right to change the Regulations, notifying Customers via the website at least 14 days in advance before the changes come into effect.

  4. These Regulations come into force on 01.01.2024 and is available on the website www.catering-foodbox.pl and at the Service Provider's registered office.
