RETURNS AND COMPLAINTS
§ 1 Withdrawal from the contract (consumer)
A consumer who has concluded a distance contract (including via a store) catering-foodbox.pl), has the right to withdraw from the contract without giving any reason within the time limit 14 days from the date of delivery of the item.
The right to withdraw from the contract not entitled to the consumer in the case of contracts referred to in Article 38 of the Act of 30 May 2014 on consumer rights, i.e.:
pkt 3 – a non-prefabricated item, manufactured according to the consumer’s specifications or intended to meet his or her individual needs (e.g. an individually composed menu);
pkt 4 – items that spoil quickly or have a short shelf life (e.g. fresh ready-made meals, salads, products with a shelf life of less than a few days);
pkt 5 – an item delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons (e.g. opened hygiene or cosmetic products).
The Seller indicates in the description of each product whether it is subject to exclusion of the right of withdrawal.
In the event of effective withdrawal from the contract, the Seller will return all payments received within the deadline. 14 days from the receipt of the declaration of withdrawal. The refund takes place in the same wayby which the payment was made (unless the Consumer expressly agreed to another method).
The Seller does not accept return shipments sent cash on delivery.
In particularly justified cases, it is possible to cancel the order before production begins.
§ 2 Checking the order upon receipt
The consumer has the right to check the order upon receipt to the extent necessary to determine its compliance with the contract.
Failure to check the goods in the presence of the courier or driver, as well as the lack of a written receipt protocol, does not deprive the Consumer of the right to file a complaint.
The Seller does not require the preparation of an acceptance protocol as a condition for considering the complaint.
§ 3 Liability for technical errors
The Seller is responsible to the Consumer for the proper functioning of the payment systems provided in the Store. In the event of errors caused by payment platforms or banks, the Seller will take steps to resolve the issue and, if necessary, issue a refund.
§ 4 Complaints (non-conformity of goods with the contract)
4.1 Submitting a complaint
The consumer may file a complaint if he/she finds non-conformity of the goods with the contract and/ or hidden defect.
Complaints can be submitted:
in writing to the following address: Kłobucka Street 11, 02-699 Warsaw;
in electronic form to the e-mail address: info@catering-foodbox.pl;
orally at the point of delivery of the goods.
4.2 Content of the complaint
The complaint should include:
Customer data (name, surname, address, order number);
description of the nonconformity or defect;
Customer's request (replacement, repair, price reduction, withdrawal from the contract).
4.3 Processing deadline
The seller will consider the complaint within the deadline 14 days from the date of its receipt and informs the Client about the result by e-mail or telephone.
4.4 Form of refund
If the complaint is accepted, the money will be refunded. in the same formin which the payment was made (bank transfer, PayU, payment card).
Gift Voucher on products can be offered to the Customer only when the Customer expressly and voluntarily agrees to this form of return.
§ 5 Product defects (warranty)
The Seller undertakes to deliver the goods to the Customer free from defects.
If a defect is found, the Customer may request:
exchange goods free from defects;
deletion defects;
price reduction in proportion to the reduction in the value of the goods;
withdrawal from the contract (if the defect is significant).
If the customer is Consumer, may choose the method of satisfying its claims (e.g. replacement instead of repair), unless the chosen method is impossible or would require excessive costs compared to the method proposed by the Seller.
The consumer cannot withdraw from the contract if the defect is insignificant.
Dealer cannot refuse to comply with the request due to the fact that the goods were not checked upon receipt by the courier or no protocol was prepared.
§ 6 Extrajudicial dispute resolution
The Seller consents to amicable (out-of-court) settlement possible consumer disputes.
The consumer has the option of using the following extrajudicial remedies:
turning to permanent consumer arbitration court;
turning to provincial inspector of the Trade Inspection with a request for mediation;
turning to district (municipal) consumer rights ombudsman;
using the assistance of a social organization dealing with the protection of consumer rights.

Customer Responsibility
Dealer is not responsible for damages caused as a result of the Customer providing third parties with passwords, logins, access data to e-mail or user account, or in the event of illegal acquisition of such data by third parties (theft, burglary).
§ 8 Final provisions
These Regulations define the rules for making purchases in the Online Store. Foodbox Catering (catering-foodbox.pl). Placing an order constitutes acceptance of all provisions of the Regulations.
In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular:
Civil Code (Act of 23 April 1964);
Competition and Consumer Protection Act (of 16 February 2007);
Act on Out-of-Court Resolution of Consumer Disputes (from 23 September 2016).
Change of Regulations:
The Seller has the right to change the Regulations.
Changes are published on the website catering-foodbox.pl.
For contracts concluded before the amendment of the Regulations, the version of the Regulations in force on the date of conclusion of the contract shall apply.
The customer with a user account will be informed of the change by e-mail.
If the changes are not accepted, the Customer may immediately delete the user account without incurring any costs.
Minimum technical requirements for using the Store:
browser: Microsoft Edge, Mozilla Firefox, Opera, Chrome, Safari;
JavaScript enabled.
From the Store can not use anonymously.
The Seller reserves the right to introduce temporary promotions and change the product range.
Prohibited Customer Actions:
sending illegal, offensive, racist, discriminatory or pornographic content;
using the Store for marketing or advertising activities without the Seller's consent;
infringing upon the personal rights of third parties or intellectual property rights;
taking actions that disrupt the operation of the Store (including the use of malicious software);
disseminating content available in the Store outside its area, exceeding permitted personal use;
sharing access data to the user account with third parties.
